IMPORTANT NOTICE:

The Terms of Use (“Terms of Use” or “Terms”) have been last updated on 28 November 2023 and supersede and replace all prior Terms.

Entertainment Platform NOT a Gambling Platform: We do not offer any real money gambling on our Platform. No money or purchase of any kind is required to play, enter, or to win on our Platform.

Terms are a Legal Agreement: These Terms form a binding legal agreement between you and us and apply to your use of or access to our Platform on any electronic device. 

NOTICE OF ARBITRATION PROVISION: These Terms include a mandatory arbitration provision which, subject to certain exceptions, requires that any past, pending, or future disputes between you and us, shall be resolved by final and binding arbitration on an individual and not class-wide or consolidated basis. If you do not wish to be subject to arbitration on these terms and you have not previously agreed to an arbitration provision in connection with your use of the Platform, you may opt out of the arbitration provision in connection with your use of the Platform within thirty (30) days of entering this agreement by following the instructions provided at the end of the section titled “MUTUAL ARBITRATION PROVISIONS AND CLASS-ACTION WAIVER.”

YOU MAY NOT OBTAIN PRODUCTS OR SERVICES FROM THE WEBSITE IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT AT LEAST 18 YEARS OF AGE, OR (C) ARE PROHIBITED FROM ACCESSING OR USING THIS WEBSITE OR ANY OF THIS WEBSITE’S CONTENTS, PRODUCTS OR SERVICES BY APPLICABLE LAW.

YOU SHALL NOT USE THE WEBSITE FOR ANY ILLEGAL PURPOSES, AND YOU WILL USE IT IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS. YOU SHALL NOT USE THE WEBSITE IN A WAY THAT MAY CAUSE THE WEBSITE TO BE INTERRUPTED, DAMAGED, RENDERED LESS EFFICIENT OR SUCH THAT THE EFFECTIVENESS OR FUNCTIONALITY OF THE WEBSITE IS IN ANY WAY IMPAIRED. YOU AGREE NOT TO ATTEMPT ANY UNAUTHORIZED ACCESS TO ANY PART OR COMPONENT OF THE WEBSITE.

SCOPE OF TERMS: To ensure our Terms are clear, some terms are set out in separate links or in different parts of our Platform. Before using our Platform, you should read and understand all of our policies, including these Terms and the Sweeps Rules, as they form the basis of the legal contract between you and us. The Terms include all of the following:

1. Terms of Use, which includes the Rules of Game Play;
2. Responsible Social Gaming Policy, which gives you an extensive suite of automated, customised tools and tips to ensure that you enjoy your social gaming experience, have fun and are in control of how you play in a safe environment. The tools are contained in Responsible Gaming Controls;
3. Privacy Policy, which explains the information we collect about you, how we will use it, the lawful basis for use and who we will give the information to; and
4. Sweeps Rules, which explain the rules relating to you playing Sweepstakes on our Platform.

ACCEPTANCE OF TERMS: By visiting the Platform, registering an account on the Platform (“Account”), checking the box confirming acceptance of these Terms, and/or using the Platform, you confirm that you:

1. have read and understand the Terms (including any amendments thereto);
2. have the right authority and capacity to agree to be bound by the Terms;
3. agree to be bound by the Terms; and 
4. that your use of or access to the Platform, shall be subject to the Terms.

Please read the Terms prior to using the Platform as they may have changed since your last visit. 

If you do not agree to any provision or aspect of the Terms, you must not use our Platform.

ELIGIBILITY AND VERIFICATION CHECKS: You must meet the Eligibility Criteria to open an Account and/or play on the Platform. You must complete Verification Checks to purchase Lucky Coins and/or redeem prizes relating to Sweeps Coins (“Prizes”). Players may be excluded from using our Platform for numerous reasons including but not limited to geographic location, breaching applicable law, or failing to successfully complete the applicable Verification Checks. 

THE PARTIES 

Who you are: References to “you” and “your” are to visitors to the Site or App and/or players of the Platform. 

Who We are: This website www.heustongaming.com (the “Site”) and/or the Heuston Gaming mobile application (the “App”) (the “Site,” “App,” and any and all associated websites, mobile sites, and mobile applications collectively referred to herein as the “Website(s)”) are operated and controlled by the Heuston Gaming Group (“Heuston Gaming,” Sweeptastic,” “we,” “us,” or “our''). The online social game, Sweeptastic, is a brand owned and operated by Heuston Gaming Group. 

Heuston Gaming Group is comprised of the following entities:

1. Heuston Gaming Malta Limited, a limited liability company incorporated in Malta (company registration number C76987), subject to Maltese law, having its registered address at 5th Floor, CF Business Centre, Triq Gort, St Julians, Malta.
2. Heuston Gaming Limited, a limited liability company incorporated in Ireland (company registration number 733653), subject to Irish law, having its registered address at #19, G5, 3015 Lake Drive, Citywest, Dublin D24DKP4, Ireland.
3. Heuston Gaming Inc, a Delaware C Corporation incorporated in the United States of America (company registration number 20249193), having its registered address at 651 N Broad St, Suite 201, Middletown, DE 19709, USA. Heuston Gaming Inc. operates from 4498 Main St, Ste 4 #1347, Amherst, NY 14226, USA.

Each member of the Heuston Gaming Group is entitled to exercise any of the rights or obligations of the other members of the Heuston Gaming Group.

OTHER DEFINITIONS 

“Content” or “Website Content” means text, graphics, user interfaces, visual interfaces, photographs, trade marks, logos, sounds, music, artwork, computer code and other material used, displayed or available as part of the Games and Platform, including the Lucky Coins and Sweeps Coins.

“Game” means any one or more Game(s) available on the Platform that may be played by you by using either Lucky Coins or Sweeps Coins. We reserve the right to add and remove Games from the Platform at our sole discretion.

“Lucky Coins” are virtual coins that can be utilised to play Games on the Platform for a chance to win Lucky Coins. Lucky Coins can be purchased on our Platform. The exclusive benefits associated with playing Games with Lucky Coins include membership of the Lucky Coins Rewards Clubs, access to exclusive Games and potentially Game’s Lucky Coins Tournament.

The “Platform” means the services provided through any URL or mobile application owned by, or licensed to, Heuston Gaming, and branded as part of the "Sweeptastic" family of games, including the website located at https://www.sweeptastic.com, and all subdomains, subpages and successor sites thereof, as well as all Games, features, tools and services available thereon.

“Sweeps Coins” are virtual coins that can be utilised to play Games (save the Games that are limited to players using Lucky Coins) on the Platform and enter for a chance to win Sweeps Coins. Sweeps Coins are free to obtain and cannot be purchased on our Platform. Sweeps Coins have no monetary value. Sweeps Coins may be redeemed for Prizes.

AMENDMENTS TO THE TERMS

We reserve the right to amend any provision of these Terms at any time for any reason, including but not limited to commercial reasons, in response to change in law or regulation, and/or customer service reasons. Any amendments will be published on the Platform and such changes will be binding and effective immediately once published.

It is your responsibility to check the Terms prior to commencing use of the Platform. Whenever we amend these Terms in a way that, in our view, would limit your current rights or which may be to your detriment, we will endeavour to notify you either via email and/or via pop-up upon your next visit to the Platform. Regardless of whether or not you receive and/or review any such notifications, you agree to be bound by the changes by your continued use of the Platform. If you do not agree to the amended Terms, you must stop using the Platform.

INTELLECTUAL PROPERTY RIGHTS

Our IP Rights: You acknowledge and agree that all of our trademarks, logos, copyrights and any and all other intellectual property rights in all material or content contained within this Website shall remain at all times vested in us or, in the cases where we are using such material or content under authority from a third party, in the owner of such material or content.

We grant you the limited right to access and make use of the Website as our customer. However, you shall not: (a) reproduce, duplicate, copy, sell or otherwise exploit the Website or any image, page layout, page design, trade dress, trademark, logo or other content (“Content” or “Website Content”) for any commercial purpose; (b)  use a robot, spider or data mining or extraction tool or process to monitor, extract or copy Website Content; (c) use any meta tags, search terms, key terms, or the like that contain the Website’s name or our trademarks; (d) engage in any activity that interferes with the Website or another user’s ability to use the Website; (e) modify, create derivative works from, reverse engineer, decompile or disassemble any technology used to provide the Website and the goods or services offered on the Website; or (f) assist or encourage any third party in engaging in any activity prohibited by these Terms of Use.

You may not shall not use, copy, distribute, or exploit any of the Website Content in any manner without our prior written permission. 

All Website Content and all materials and content contained within the Website, including but not limited to the text, graphics, logos, icons, images, audio clips, video clips, articles, posts and data appearing on the Website, are owned by us, or used by us under authorization, and are protected by U.S. and foreign trademark and copyright laws. No portion of the materials or content on these pages may be reprinted or republished in any form without our express written permission.

Licence you Grant to us: You grant us, and represent and warrant that you have the right to grant us, an irrevocable, perpetual, worldwide, non-exclusive, royalty-free licence to use in whatever way we see fit, any information, images, videos, comments, messages, music or profiles (including your username) you publish or upload to any website or social media page controlled and operated by us including any Website Content you post or publish as part of a Promotion.

YOUR USE OF THE SITE(S)

Our Right to Modify the Content and Platform: We have the right to regulate, control, modify and eliminate any Content (including but not limited to Games, Lucky Coins or Sweeps Coins), the Platform, and the Site(s), in our sole discretion, to the extent permissible by law. We have no liability to you for the exercise of such rights.

No Licence in a Restricted State / EU jurisdiction: You shall not be granted any licence to use the Platform or Content in a Restricted State or any EU jurisdiction within which it is illegal.

Actions not permitted by you as user of the Site(s): You agree not to:

1. hack into any part of the Games or Platform through password mining, phishing, or any other means;
2. knowingly introduce viruses, Trojans, worms, logic bombs, spyware, malware, or other similar material;
3. attempt to disassemble, modify, reverse engineer, or derive source code to any part of the Games or Platform;
4. engage in any form of cheating or collusion including allowing multiple players access our Account;
5. use the Platform to facilitate any type of unlawful or fraudulent activity, including without limitation illegal money transfer (including money laundering proceeds of crime). If we suspect that you may be engaging in, or have engaged in fraudulent, unlawful or improper activity, your access to the Platform will be suspended immediately and your Account may be closed. If your Account is suspended or closed under such circumstances no redemptions shall be permitted on your Account. In addition, we may pass any necessary information on to the relevant authorities, other online service providers, banks, credit card companies, electronic payment providers or other financial institutions. You will cooperate fully with any investigation into such activity that we may undertake. 

Notification requirement for suspected Fraud: If you suspect any unlawful or fraudulent activity or prohibited transaction by another user of the Site(s), please notify us immediately via email to: [email protected].

THIRD PARTY WEBSITES AND LINKS 

General: The Website may contain links to websites owned by third parties including but not limited to those who may invite you to participate in promotional offers or rewards, third payment providers or advertisers (“Third Party Websites”). We do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content (including misrepresentative or defamatory content) of any Third Party Websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offense caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such third-party external sites or resources.

You are solely responsible for any obligations or charges when dealing with any Third Party Website. You should read and understand the terms of use of a Third Party Website (including their privacy policy) prior to engaging with them. 

Some Third Party Websites may be fraudulent in nature or not adhere to applicable laws. You agree that we are not responsible for any use of, access to, or actions you take at their request, including the provision by you of your personal information to them or their collection, storage or use of such personal information. 

We generally welcome the hyper-linking to Third Party Websites, which we consider are appropriate, provided that such links are to our home-page and that we have given written permission to the establishment of such links. Such consent may be withheld at our sole discretion.

Offers of Lucky Coins or Sweep Coins: We do not authorize any Third Party Website to offer Lucky Coins or Sweeps Coins. Any such offer should be deemed fraudulent and disregarded.

Social Media Sites: When using any social media sites, including without limitation those that we provide links to such as Facebook®,  Twitter®, LinkedIn®, Instagram®, and YouTube®, or that you access our Platform through, you acknowledge and agree that:

1. any comments or content that you post on such sites are subject to the terms and conditions of that particular site(s);
2. you will not post any comments on the site(s) that are false, misleading or deceptive or defamatory to us, our employees, agents, officers or other players; and
3. we are not responsible or liable for any comments or content that you or others post on site(s) (including without limitation other players' comments or content relating to you). 

ERRORS, INACCURACIES, MALFUNCTIONS, AND INTERRUPTIONS

We strive to provide complete, accurate, up-to-date information on the Website. Unfortunately, despite those efforts, human or technological errors may occur. The Website may contain typographical mistakes, inaccuracies, or omissions, and some information may not be complete or current. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time without prior notice.

Moreover, if there is any error (whether caused by human error, operational failure or systems error or a combination of these) or malfunction or interruption in the Game or the Platform for any reason (including without limitation failure of internet, connectivity, loss or corruption of data, latency in communications, technical failure or disaster), then all corresponding play, winnings of Lucky Coins or Sweeps Coins may be deemed void at our sole discretion. This includes without limitation any error in Pay-out Rate, minimum or maximum Lucky Coins or Sweeps Coins required / or that can be used to play a Game, or amount of Lucky Coins or Sweeps Coins displayed as winnings or to your Account balance.  

Any amounts of Lucky Coins or Sweeps Coins credited to your Account balance in these circumstances will be deemed void, remain our property, and will be deducted from your Account balance. Any corresponding Prizes redeemed, shall be held on trust by you for us and shall be immediately repaid or returned to us, on receipt of any demand from us. You agree to report any errors that you see to us immediately via emailing [email protected].

If a Game starts but does not conclude because of a failure of our Platform, we will use commercially reasonable efforts to reinstate the amount of Lucky Coins or Sweeps Coins played (whichever applicable) in the Game to you by crediting it to your Account. We reserve the right to alter Account balances and details to correct such mistakes.

DISCLAIMERS 

WE MAKE NO WARRANTIES, WHETHER EXPRESS OR IMPLIED IN RELATION TO THE ACCURACY OF ANY INFORMATION ON THE WEBSITE. THE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY REPRESENTATION. WE MAKE NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, IN RELATION TO THE WEBSITE, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, COMPATIBILITY, SECURITY, ACCURACY, CONDITION OR COMPLETENESS, OR ANY IMPLIED WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OR TRADE. 

WE MAKE NO WARRANTY THAT THE WEBSITE WILL MEET YOUR REQUIREMENTS OR WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR BUGS OR ARE FULLY FUNCTIONAL, ACCURATE, OR RELIABLE. 

AS SET FORTH IN THE WEBSITE PRIVACY POLICY, YOU ACKNOWLEDGE THAT WE CANNOT GUARANTEE, AND THEREFORE SHALL NOT BE IN ANY WAY RESPONSIBLE FOR, THE SECURITY OR PRIVACY OF THE WEBSITE AND ANY INFORMATION PROVIDED TO OR TAKEN FROM THE WEBSITE BY YOU.

LIMITATION OF LIABILITY 

WE WILL NOT BE LIABLE FOR ANY ECONOMIC LOSSES (INCLUDING WITHOUT LIMITATION LOSS OF REVENUES, PROFITS, CONTRACTS, BUSINESS OR ANTICIPATED SAVINGS) OR ANY LOSS OF GOODWILL OR REPUTATION, OR ANY LOSS OR CORRUPTION OF DATA, OR ANY SPECIAL OR INDIRECT OR CONSEQUENTIAL LOSSES ARISING OUT OF YOUR USE OF THE WEBSITE; IN ANY CASE WHETHER OR NOT SUCH LOSSES WERE WITHIN THE CONTEMPLATION OF US AT THE DATE ON WHICH THE EVENT GIVING RISE TO THE LOSS OCCURRED. 

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

To the maximum extent permitted by applicable law, Heuston Gaming, our affiliates, officers, employees, agents, partners and licensors will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, personal injury or property damage, loss of data, loss of use, loss of anticipated savings, accrued but wasted expenditure, cost of procurement of substitute goods or services, loss of good-will, or other intangible losses, resulting from:

1. your access to or use of or inability to access or use the Platform or any damage caused by the Platform. We cannot and do not guarantee continuous, uninterrupted, or secure access to the Platform;
2. any conduct or content of any third party on the Platform, including without limitation any content, products or services provided by any advertisers, affiliate advertising networks, rewards program operators, payment providers we may cooperate with or any other users of the Platform and any Third Party Website or Link;
3. any content and/or information obtained from the Platform or reliance upon the Platform or any part thereof including any loss or damage to your Account information including without limitation, any personal information, statistics, Lucky Coins, Sweeps Coins or Prizes; and
4. unauthorized access or use or alteration of any material or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we knew of or ought to have known of the possibility of such damages.

Maximum Liability: To the maximum extent permissible under applicable law, our total liability and/or the liability of our affiliates is limited to the total amount you have paid us via purchases of Lucky Coins in the six (6) months immediately preceding the date on which your cause of account arose.

Waiver and Release: You waive and release us and our subsidiaries, affiliates, partners, officers, directors, employees and agents from any liabilities arising from or related to any act or omission of such third parties in connection with your use of the Platform.

Exclusion:  Nothing in these Terms will operate so as to exclude our liability for death or personal physical injury that is directly and caused by our negligence or willful misconduct.

INDEMNIFICATION

YOU AGREE TO BE FULLY RESPONSIBLE FOR (AND FULLY INDEMNIFY US AGAINST) ALL CLAIMS, LIABILITY, DAMAGES, LOSSES, COSTS AND EXPENSES, INCLUDING LEGAL FEES, SUFFERED BY US AND ARISING OUT OF ANY USER CONTENT YOU POST TO THE WEBSITE AND ANY BREACH OF YOUR REPRESENTATIONS AND WARRANTIES OR THESE TERMS OF USE BY YOU OR ANY OTHER LIABILITIES ARISING OUT OF YOUR USE OF THE WEBSITE, OR THE USE BY ANY OTHER PERSON ACCESSING THE WEBSITE USING YOUR COMPUTER OR INTERNET ACCESS ACCOUNT. 

1. Final Decision: In the event of a discrepancy between the result shown on a user’s device and our server software, the result showing on our server software will be the official and governing result.
2. Changes to the Platform: We reserve the right to suspend, modify, remove or add Content (including Games) to the Platform at its sole discretion with immediate effect and without notice to you. We will not be liable to you for any loss suffered as a result of any changes made or for any modification or suspension of or discontinuance of the Platform (including any Game thereon) and you will have no claims against us in such regard.
3. Platform Suspension: We may temporarily suspend the whole or any part of the Platform for any reason at our sole discretion. We may, but will not be obliged to, give you as much notice as is reasonably practicable of such suspension. We will restore the Platform, as soon as is reasonably practicable, after such temporary suspension.
4. Viruses: Although we take all reasonable measures to ensure that the Platform is free from viruses we cannot and do not guarantee that the Platform is free of such problems. It is your responsibility to protect your systems and have in place the ability to reinstall any data or programs lost due to a virus.

MUTUAL ARBITRATION PROVISIONS AND CLASS-ACTION WAIVER

Except where prohibited by law or set forth below, as a condition of using the Platform and any related services, you hereby agree that: (1) any and all disputes and causes of action arising out of or connected with the use of the Platform, including but not limited to any Sweepstakes or Prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of JAMS. To the extent permitted by the governing rules, the arbitration shall be conducted by written submissions only, or video conference technology such as Zoom. If the governing rules do not so permit, the arbitration shall be held at the JAMS location nearest to your residence. If JAMS is unavailable, unwilling, or otherwise unable to administer an arbitration in accordance with these rules, then another administrator that will do so will be selected by agreement of the parties.  If the parties cannot agree, then they will jointly petition a court to appoint an administrator that will do so; (2) the Federal Arbitration Act (9 U.S.C. §1 et seq.) shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will either party be permitted to obtain awards for-- and you and we hereby waive all rights to claim-- punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses. You and we further waive all rights to have damages multiplied or increased.  

Disputes Excluded From Arbitration Requirement: The following disputes are excluded from the requirement to arbitrate: (1) any dispute seeking to enforce or protect, or concerning the validity of intellectual property rights; (2) individual claims brought in small claims court. The term “small claims court” shall mean a court with a maximum monetary jurisdiction limit of $15,000 (fifteen thousand dollars) or less; (3) any claim that an applicable federal statute expressly states cannot be arbitrated; and (4) any claim for injunctive relief.

Class Action Waiver. To fullest extent permitted by applicable law, you agree to bring any dispute, whether in arbitration or in a court of law as permitted by these terms, ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION, MASS ACTION OR COLLECTIVE ACTION. There will be no right or authority for any dispute to be brought, heard or arbitrated as a class or collective action ("Class Action Waiver"). 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, any aspect of the Platform or any Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any other jurisdiction.

Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, You agree that, by using the Platform or registering with us or on the Platform: (i) any and all disputes, claims, and causes of action arising out of or in connection with the Platform, any Sweepstakes or any Prize awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees; and (iii) under no circumstances will You be permitted to obtain any award for-- and you hereby waive all rights to claim-- punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

Waiver of Jury Trial.  BOTH YOU AND WE HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO A JURY TRIAL. We are instead mutually electing that all disputes, claims, or requests for relief shall be resolved by arbitration under this Arbitration Agreement, except as specified herein.  An arbitrator can award on an individual basis the same damages and relief as a court and must follow these rules in the same manner as a court would.  

Thirty-Day Right to Opt Out. You have the right to opt out of the arbitration requirement by sending written notice of your decision to opt out to the following e-mail address: [email protected] within thirty days after first becoming subject to these terms. Your notice must include your name and address, the e-mail address you used to set up your online account (if you have one), and an unequivocal statement that you want to opt out of the arbitration requirement. In the event you opt out, all other parts of this Agreement will continue to apply.  Opting out of this arbitration agreement has no effect on any other obligations to arbitrate that you may currently have, or may enter in the future, with us.

Disputes and Claims one year time limit: We both agree that any dispute, claim(s), lawsuits, regardless of form, arising out of or related to the Platform or these Terms must be filed within ONE (1) YEAR of the action, omission, event or occurrence giving rise to the Dispute, claim(s) or lawsuit, after which such dispute, claim(s) or lawsuit will be time-barred and prohibited, without regard to any longer period of time which may be provided by any period of limitation or pursuant to law or statute.

COPYRIGHT INFRINGEMENT NOTICE

We respect the intellectual property rights of others. If you believe there is Content on our Platform that constitutes copyright infringement pursuant to the Digital Millennium Copyright Act, please notify us via email to: [email protected].

Applicable law requires that the notice must include all of the following:

• A physical or electronic signature of the owner of the right claimed to be infringed or the person authorized to act on the owner’s behalf;
• A description of the copyrighted work claimed infringed;
• Information the location of the material on the Platform;
• Your name, address, telephone number, e-mail address;
• A statement by You that You have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; and
• A statement made under penalty of perjury, that the above information in the notice is accurate and that you are the copyright owner of the right claimed to be infringed or violated or act on their behalf.

Before you file your notice, please carefully consider whether or not the use of the copyrighted material at issue is protected by the Fair Use doctrine. If you file a notification when there is no copyright infringement, you could be liable for damages including costs, attorneys’ fees.

OTHER TERMS

Entire Agreement: These Terms constitute the entire agreement between you and us with respect to your use of the Platform and, save in the case of fraud, supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and us with respect to your engagement on the Platform.

Tax: You are solely responsible for any taxes which apply to any Prizes that you collect from your Participation. We will not give you tax or legal advice.

Force Majeure: Heuston Gaming will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside of our reasonable control.

No agency: Nothing in these Terms will be construed as creating any agency, partnership, trust arrangement, fiduciary relationship or any other form of joint enterprise between you and us.

Severability: If any of these Terms, including but not limited to the section entitled "Mutual Arbitration Provisions and Class-Action Waiver," are found to be illegal, void or unenforceable, that portion will be severed, and it shall not affect the validity and enforceability of the remainder of these Terms which shall continue in full force and effect, are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will, to that extent, be severed from these Terms. All remaining terms, conditions and provisions will continue to be valid to the fullest extent permitted by law. In such cases, the part deemed invalid or unenforceable will be amended in a manner consistent with the applicable law to reflect, as closely as possible, the original import of the invalid or unenforceable provision.

Explanation of Terms: We consider these Terms to be open and fair. If you need any explanation regarding these Terms or any other part of our Platform contact Customer Support via email at [email protected]. The Terms prevail over any communication with us regardless of the medium (including without limitation email, chat or social media). All correspondence between you and us may be recorded / retained.

Assignment: These Terms are personal to you, and are not assignable, transferable or sub-licensable by you except with our prior written consent. We reserve the right to assign, transfer or delegate any of our rights and obligations hereunder to any third party without notice to you.

Business Transfers: In the event of a change of control, merger, acquisition, or sale of assets of Heuston Gaming, your Account and associated data may be part of the assets transferred to the purchaser or acquiring party. In such an event, we will provide you with notice via email or via our Platform explaining your options with regard to the transfer of your Account.

Language: These Terms may be published in several languages for information purposes and ease of access by players but will all reflect the same principles. It is only the English version that is the legal basis of the relationship between you and us and in case of any discrepancy between a non-English version and the English version of these Terms, the English version will prevail.

Notices: Notices and other communications delivered or mailed to the postal address or email address provided by you in your Account, shall be deemed to be personally delivered once sent, whether or not actually received.

Account Communications / Complaints

1. Our Contact details: To contact our Customer Support or make a complaint, you must contact us via email at [email protected].
2. Email Requirement: All email communications between you and us should be carried out using the email address that you have registered in your My Account (“Account Email”). Failure to do so may result in our response being delayed or you receiving no response.
3. Complaint Information: The following information must be included in any written communication with us (including a complaint / claim):
   1. your username;
   2. your first and last name, as registered on your Account;
   3. a detailed explanation of the complaint/claim; and
   4. any specific dates and times associated with the complaint/claim (if applicable).
4. Delays in Response: Failure to submit a complaint via your Account email with the information outlined above may result in a delay in our ability to identify and respond to your complaint/claim in a timely manner. Customer Service will inquire into official complaints as soon as is reasonably possible and will endeavour to respond to official complaints within 10 calendar days of receipt of a valid complaint / claim. If there is cause for a delay to your response, we will email you to confirm the delay and corresponding expected duration of the delay.

RULES OF GAME PLAY

Eligibility Criteria

To register to play on the Platform and open your own Sweeptastic account (“Account”) and/or to continue to use the Platform and/or your Account, you declare and warrant that:

1. you are legally capable of entering into a binding contract including these Terms. You have read and fully understand the Terms;
2. all registration information that you provide to us when opening your account is true, accurate, complete and up to date. We or any third party acting on our behalf, have the right to verify your account details. You will immediately notify us of any changes to the information previously provided by you. See Verification of your Details section below for further details;
3. you are over 18 years of age or the minimum legal age of majority as stipulated in the jurisdiction of your residence and are, under the laws of the jurisdiction applicable to you, legally allowed to play all of the Games offered on the Platform. You will comply with the Account Rules detailed below, at all times. You will not access your account from a Restricted State / EU jurisdiction within which use of the Platform is illegal including but not limited to the following States in the USA - Washington, Idaho, Nevada and Michigan (“Restricted State). See Account Access Rights below for more information;
4. you shall participate in the Games strictly in your personal capacity for recreational and entertainment purposes only and not for any third party (including any commercial entity);
5. you are not subject to self-exclusion on this Platform or any similar platform;
6. you are not bankrupt or subject to any / any potential bankruptcy proceedings in any jurisdiction;
7. you have read and understand the Responsible Social Gaming Policy are aware of all of the extensive, automated, customised Responsible Gaming Controls available to you and will utilise them as required by you;
8. you do not have any ownership rights in the Platform but have a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform;
9. Heuston Gaming is the owner or authorized licensee of all intellectual property in relation to any Content;
10. any money that you use to purchase Lucky Coins is not tainted with any illegality and, in particular, does not originate from any illegal activity or source;
11. you will not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to your or any third parties' use of the Platform and you will not use any software-assisted methods or techniques (including but not limited to bots designed to play automatically) or hardware devices for your participation in any of the Games; 
12. you shall only use a valid Payment Method accepted on the Platform accepted on the Platform to purchase Lucky Coins which, is in your name, matches your personal details in My Account and lawfully belongs to you (“Payment Method”); 
13. you are not an employee of Heuston Gaming, any of their respective affiliates, subsidiaries, holding companies, advertising agencies, or any other company or individual involved with the design, production, execution or distribution of the Games and their immediate family (spouse, parents, siblings and children, whether the relationship is by birth, marriage or adoption) or household member (people who share the same residence at least 3 months of the year);
14. you are responsible for retaining a copy of your transaction records and merchant policies; and
15. you consent to and are aware that third parties perform some essential tasks on the Platforms on behalf of Heuston Gaming including without limitation, Verification Checks and payment processing. You consent to us sharing your data with them in accordance with the Privacy Policy. 

Failure to comply with any of the Eligibility Criteria will result in the closing of your account and forfeiture of any Lucky Coins or Sweeps Coins, without prejudice to any other rights or remedies available to us. 

Log-in and Account Creation:

1. To sign up or Log-in to the Platform including to enjoy the exclusive benefits of playing with Lucky Coins, you must:
   1. provide us with your email and unique password, or sign up using Facebook®; and
   2. Check the box to accept the Terms, Sweeps Rules and the Privacy Policy and some key provisions in the Terms.
2. To purchase Lucky Coins you must:
   1. complete the steps outlined in section 1 (Log-in and Account Creation) above; 
   2. Complete your profile details by furnishing all Mandatory Information in the My Account section of your Account and choose a unique username; and
   3. Pass the Initial Verification Checks.
3. To redeem Prizes you must:
   1. Complete the steps outlined in section 1 and 2 (Log-in and Account Creation) above; and
   2. Pass the Final KYC Verification Checks.

Verification of your Details

1. Verification Requirement: You must successfully complete Verification Checks of your Account details in order to purchase Lucky Coins and redeem Prizes on the Platform (“Registration”) which includes the provision of certain Mandatory Information and passing all Verification Checks.
2. Mandatory Information Requirements: You are required to provide complete, correct and up to date mandatory information (“Mandatory Information”). Mandatory Information is captured to purchase Lucky Coins and redeem Prizes. The Mandatory Information captured includes but is not limited to name, username, full residential address, valid email address, date of birth, mobile phone number, Social Security Number (US Residents), username and details of your preferred Payment Method. You are required to ensure that you notify us of any changes to any of your Mandatory Information as soon as possible via updating your My Account details.
3. Verification Checks: 
   1. You agree that we are entitled to conduct any Verification Checks that we may reasonably require or that are required of us under applicable laws and regulations or by relevant regulatory authorities to play on our Platform, purchase Lucky Coins or redeem any Prizes, including but not limited to:
      1. Initial Verification Checks: including but not limited to Politically Exposed Persons (“PEPs”) and Sanctions checks; and
      2. Final KYC Verification Checks:
         1. confirming your identity via requiring you to provide a selfie and government issued documentation such as a passport or driver's licence;
         2. confirming your residence including via requiring you to provide a utility bill if required;
         3. confirming current location via requiring you to enable “Location Services” on your device and / or computer; and 
         4. preventing fraud, financial crime including money laundering via requiring you to provide a pay slip / bank statement to 
         5. confirm source of wealth / funds documentation. 

The Initial Verification Checks and Final KYC Verification Checks shall be referred to as the “Verification Checks.” These Verification Checks may be required to be completed during Registration and at any time whilst your Account is open or to continue to use the Platform. It is our sole discretion as to whether or not the Mandatory Information and / or documentation furnished by you as part of the Verification Checks is valid and successfully meets our requirements. It is at our sole discretion to continue with the Verification Checks.

1. You shall respond to any request for information relating to our Verification Checks from us and/or our third party performing any Verification Checks within at least 40 days of any request.
2. All Mandatory Information and documentation received and/or generated pursuant to the Verification Checks shall be processed in accordance with our Privacy Policy. 
3. Failure to furnish the Mandatory Information / complete Verification Checks: 

Failure to furnish or keep Mandatory Information up to date, respond to our information requests in a timely manner, furnish valid documentation, and/or successfully complete any Verification Checks, may result in:

1. A delay in opening your Account;
2. Suspension of your Account  including preventing any play via Lucky Coins, Sweeps Coins or Daily Spins or your participation in the Lucky Coins Rewards Club; and/or
3. Closure of your Account and forfeiture of any Lucky Coins or Sweeps Coins.

Account Rules

1. One Account: Only one account is allowed per customer. 
2. Multiple Accounts: If you have more than one Account, we may suspend or close all Accounts. If you have an existing Account, you may not seek to register an additional Account, regardless of whether or not the existing Account is active. To reactivate an Account, please reach out to customer support via email at [email protected]. 
3. Log-in details: If you sign up using Facebook®, your Facebook® password will apply to your Account. Otherwise you can use your email and you will have to choose a password to log-in into the Platform. You can change your password at any time. You will not share these details with any third party and have responsibility for ensuring that they remain confidential. We reserve the right to modify your username if we deem it offensive, defamatory or inappropriate.
4. Account Access Rights: 
   1. You are responsible for ensuring that no third party (including a minor) has access to your Account or your Account details. You have full responsibility for any access by any third party to your Account and any corresponding unauthorised use of the Platform (including purchases of Lucky Coins, whether or not you authorised them). We are not responsible for any abuse or misuse of your Account by third parties due to your disclosure of your Account details to any third party, whether such disclosure is intentional or accidental, active or passive.
   2. You shall not attempt to sell, trade for value or otherwise transfer the benefit of access to your Account (including without limitation Lucky Coins, Daily Spin Lucky Coin Rewards Club Levels or Sweeps Coins) to any third party or acquire and/or attempt to acquire access to an Account which has been opened in the name of a third party or any corresponding benefit of access to such Account.
   3. You will only access the Account via one device at the same time and not access the Account via multiple devices.
   4. You will comply with all applicable laws, including but not limited to local, state, federal / national laws, regulations or EU Directives / Regulations (“Applicable Law”) relating to the use of the Platform. If you reside in a Restricted State where the use of the Platform is prohibited you will not seek to register an Account or play on the Platform. You will not attempt to circumvent this restriction as this will be deemed fraud. It is your responsibility to ensure compliance with Applicable Law. We are not liable for any breach of Applicable Law. If the State within which you operate becomes a Restricted State, we will email you to confirm the date upon which you will no longer be able to play on our Platform or redeem any Sweeps Coins for Prizes. Any Sweeps Coins that have not met our Minimum Play-Through Requirements by the date notified shall be forfeited. Any Sweeps Coins not redeemed by the date notified shall be forfeited. 
5. Account Security Concerns: Please contact customer support immediately via email at [email protected] if you have any concerns regarding the security of your Account including loss, theft or unauthorised disclosure of your password.
6. Behavior: Your communication with us must not consist of harassment or offensive behavior, including (but not limited to) threatening, derogatory, abusive or defamatory statements, or racist, sexually explicit, pornographic, obscene or offensive language. 
7. Chargeback: Your Account will be suspended if one or more of your purchases of Lucky Coins is subject to a reversal, "chargeback" claim or dispute, and/or a “return” notification via your Payment Method. In the event of a charge back on your Account, the amount owed will be deemed a debt owed to us and you must immediately pay via an alternate method.
8. Currency: All Lucky Coin purchases via a Payment Method are executed in USD. It is a Player's responsibility to ensure that their designated Payment Method can accept transactions in USD.
9. Transaction Fees: All foreign exchange transaction fees, charges or related costs that you may incur as a result of, or in relation to, purchases from us or Prize Redemptions be borne solely by you, including but not limited to any losses or additional costs arising from foreign exchange fluctuations.
10. Prize Redemption: All prize redemptions shall be governed by the Sweeps Rules.
11. Void Transaction Fee: Lucky Coin purchases made from within a Restricted State may be voided and refunded, minus an administrative fee of up to 10% of the total purchases made by the player, in addition to any charges that may be levied by the bank or financial institution managing the aforementioned reversal.

Account Closure / Suspension

1. Breach of Rules: We may suspend or close your Account if you breach the Terms, or if we have reasonable grounds to suspect a breach.
2. Inactive Account: We reserve the right to close your Account if it is inactive for a period of sixty days or longer. You agree that we are not obliged to give you advance notice of the closure of your Account or the corresponding reason for the closure of your Account.
3. How to Close Account: If you wish to close your Account, select “Close my account” in the Self-exclusion section of the Responsible Gaming Controls.
4. Account Suspension: your Account can be suspended for many reasons as set out in the Terms. Please contact [email protected] to resolve any suspension of your Account.
5. Account Closure: Impact on Virtual Coins: If your Account is closed for any reason other than self-exclusion, you forfeit your right to any Lucky Coins or Sweeps Coins regardless of whether or not they have met the terms of the “Redemption of Sweeps Coins” as set out in the Sweeps Rules.

Responsible Gaming Account Controls

1. Our Safety Controls: To ensure you are entertained in a safe environment, we have a clear Responsible Social Gaming Policy and provide you with extensive, automated, customised, readily accessible Responsible Gaming Controls, including but not limited to purchase limits, play limits, time limits, activity checks, timeout, and self exclusion. We may restrict your use of our Platform or exclude you from our Platform at our sole discretion, if we believe it is in your best interests. Any attempt to circumvent our Responsible Gaming Controls may lead to a permanent ban from using the Platform. We are not responsible for any successful attempts by you at circumventing our Responsible Gaming Controls including any use of our Platform or purchase of Lucky Coins regardless of the method utilised. 
2. Social Gaming controls available to you
   1. Purchase Limit: this tool allows you to set a daily, weekly or monthly limit of the number of Lucky Coins that can be purchased.
   2. Play Limit:  this tool allows you to set a daily, weekly or monthly limit of the amount of Lucky Coins that we can play per session.
   3. Time limit: this tool allows you to limit the amount of time spent on the platform per day to a designated number of hours. It will automatically log-out when the Time Limit is reached regardless of whether you were playing for the entire period. You will not be able to log-in until the next day.  
   4. Activity Check: this tool is a reminder of the time that you have spent on the website at regular intervals, set by you. It does not impose a time limit.
   5. Time out: limits your access to the Platform by a defined period, the minimum of which is 24 hours and maximum is 42 days. You will not be able to access your account during this time limit / time out period. Once the period expires you can access your Account.
   6. Self-exclusion: this tool allows you to exclude yourself from our website for periods of 6 months or more. You will not be able to access your account during the self-exclusion period. Your Account can only be reactivated post completion of the self-exclusion period chosen by you. 
   7. Reactivating Account: You may be able to reactivate your Account by sending emailing [email protected]. All requests for Account reactivation will be evaluated by Customer Support. If the reason for closing your Account previously was for Responsible Gaming reasons, you must include this in any request to reactivate your Account.  We may seek to ask you questions to ensure that you are comfortable that you are choosing the right decision for you. The decision to re-activate remains at our sole discretion. You are responsible for any implications of reopening your Account.
   8. Account Closure: Players can choose to permanently close their Account, by selecting “Close my account” in the Self-Exclusion section of the Responsible Gaming Controls.
3. Implications on Lucky Coins, Sweeps Coins of Lucky Coins Rewards Club: 

If you have self-excluded and have met the Verification Checks, we will endeavour to arrange for the redemption of your Sweeps Coins that satisfy the terms of the “Redemption of Sweep Coins” as set below which is further detailed in the “Redemption of Sweeps Coins section” in the Sweeps Rules.

Games and the Platform

1. Games Rules and Sweeps Rules: 
   1. Games Rules: Games offered on the Platform may have their own rules, which are available on the Platform by clicking into the relevant Game and by clicking on the question mark and information icons. Further information relating to how to play the game, features, settings, Game Pay-out Rates may also be found by clicking on these icons.
   2. Sweeps Rules: The current rules relating to our free Sweepstakes are set out in Sweeps Rules. 

It is your responsibility to read the Game Rules and Sweeps Rules before playing. 

1. Games Pay-out Rates: 
   1. Display of and Changes to Pay-out Rates: Games are subject to the pay-out rates which are clearly displayed  on the Platform (“Pay-out Rates”) as follows:
      1. when you hover over a Game in the Games Tab; and
      2. In the Pay-out Rate page, displayed in the footer of every page, which includes an up to date list of the payout-rate for each Game on the Platform.

We continually monitor the Games pay-out rates. We reserve the right to change the Game Pay-out Rate at our sole discretion. Any amendments to the Pay-out Rates will be displayed as detailed above.

1. How Pay-out Rate works: The Pay-out Rate reflects the theoretical return across a large number of players, over an extended period. The higher the Pay-out Rate the more likely it is that you will win Lucky Coins or Sweeps Coins. The likelihood of getting a particular outcome is not based on your previous participation in the Game. Pay-out Rate will vary on a Game by Game basis.
2. Responsibility to Check Pay-out Rate: It is your responsibility to check the Pay-out Rate and your corresponding likelihood of winning.  
3. Lucky Coins Rewards Club: You will automatically be entitled to participate in the Lucky Coins Rewards Club, which relates solely to play using Lucky Coins and has eight Lucky Coins Levels. 4. Lucky Coins Games: some games are exclusively for Lucky Coins play only including without limitation Daily Spins and Monthly Lucky Coins Tournaments. For more information see the Lucky Coins tab on Sweeptastic.
5. Daily Spin: Once in every 24 hour period, you will automatically be entitled to free Daily Spins of the wheel to win Lucky Coins. For more information see the Daily Spins tab on Sweeptastic. You will be able to purchase re-spins using Lucky Coins.
6. Monthly Lucky Coins Tournaments: In a given month, if you are one of the top players of a Game based on the amount of your Lucky Coins winnings accumulated during the month as displayed on the Leaderboard, you shall be invited to play in a Game’s Lucky Coin Tournament.
7. We make no warranty that:
   1. the Platform shall be provided error free;
   2. Errors or defects will be corrected;
   3. the Platform will be free from viruses or harmful components; or
   4. Data transmissions will be secure.

Virtual Lucky Coins and Sweeps Coins: 

1. Types: You will have two virtual coin balances on the upper left of your screen which you may play with on our Platform and include both Lucky Coins (“LC”) and Sweeps Coins (“SC”) balances. You may choose which virtual coins that you wish to play a Game with, provided that you have sufficient Lucky Coins or Sweeps Coins balances (as applicable). 
2. Obtaining Lucky Coins: You can get Lucky Coins added to your Account balance:
   1. for free, as a gift, bonus or as part of a promotion;
   2. if you purchase Lucky Coins at the Coin Store tab on Sweeptastic utilising USD; and
   3. if you are playing a Game using Lucky Coins and you win the Game, you will be awarded Lucky Coin(s). 
3. No Redemption of Lucky Coins: You may not redeem Prizes for Lucky Coins.
4. Lucky Coin purchases:
   1. Lucky Coins purchases can only occur when Mandatory Information has been included in My Account and Initial Verification has been passed.
   2. We will endeavour to add any Lucky Coins purchases to your balance in your Account instantaneously.
   3. Lucky Coins purchases can be made in the Coin Store utilising USD. You can purchase Lucky Coin packages. You may be given additional free Lucky Coins or Sweeps Coins as a bonus to you for buying a Lucky Coins package upon completion of purchase of your Lucky Coins.
5. Using Lucky Coins: The amount of Lucky Coins required to play each Game will be detailed next to the game. You will be able to increase the amount of Lucky Coins you play at your discretion.
6. No Refunds of Lucky Coin Purchases: 
   1. Purchase Limits: Purchases of Lucky Coins are final and are not refundable, transferable or exchangeable. The purchase of Lucky Coins is not the deposit of funds which can be withdrawn or refunded to you. Lucky Coins do not have any real money value.
   2. Billing Issues: You agree to notify us about any purchase / billing problem(s) or discrepancies within 30 days from the date of your purchase. If you do not, you agree that you waive your right to dispute the purchase / billing problem(s) or discrepancies.
7. Obtaining Sweeps Coins: 

Once you have created an Account, there are multiple means by which you may obtain Sweeps Coins:

1. Free Sweeps Coins: You may obtain Sweeps Coins without making a purchase via one of the following methods:
   1. when you create an Account either via signing up directly with your email address and password or via Facebook ®;
   2. when you Log-in to your Account;
   3. once you have successfully completed Verification Checks (for details of Verification, see here); 
   4. as part of a promotion that may be offered by Sponsor from time to time; or
   5. as a bonus to you for buying a Lucky Coins package upon completion of purchase of your Lucky Coins package.

The minimum number of Sweeps Coins that you will receive for free as a gift or bonus is one (1) Sweeps Coins. It is at our sole discretion to whether or not or when you will receive any of the gifts / bonuses set out above.

1. Winning Sweeps Coins / Prize Winner Notification: If you are playing a Game using Sweeps Coins and you win the Game, you will be awarded Sweeps Coins, which will be reflected in your Sweeps Coin balance in your Account.
2. Free Alternative Method of Entry: As long as you have an active Account that has met all Verification Checks and is not suspended or closed, you may send a Request Card by post for five (5) free Sweeps Coins, subject to adherence to the Free Alternative Method of Entry method in the Sweeps Rules.
3. No Purchase of Sweeps Coins: You may NOT purchase Sweeps Coins and they have no monetary value.
4. Redemption of Sweeps Coins: You may redeem Sweeps Coins for Prizes pursuant to the Sweeps Rules, subject to meeting the Minimum Redemption Requirement and not exceeding the Maximum Redemption Value (if applicable), the Maximum Daily Redemption Value and the Maximum Redemption Requests. 5. Sweeps Coins and Lucky Coins Expiry: Sweeps Coins and Lucky Coins are valid for 60 days from the date you last logged on to your Account (“Coin Expiry”). Sweep Coins that have met the Coin Expiry cannot be redeemed by you, they will be deemed void and shall no longer appear in your Account. Lucky Coins that have met the Coin Expiry will be deemed void and shall no longer appear in your Account.We will notify you of any change in the duration of the Coin Expiry.  

Payment Methods / Payment Administration Agents:

1. Valid & Verified Payment Method: Your payment method must be valid and accepted on the Platform. Payment Methods accepted on the Platform include but are not limited to any credit or debit card, online wallet (e.g. PayPal or Skrill), financial/bank account. We may verify the details of your Payment Method at any time. If it comes to our attention that the name / personal details you registered on your Account and the name / personal details linked to your Payment Method differ, your Account will be immediately suspended until we can ensure that your Mandatory Information is correct and all Verification Checks are complete.
2. Use of Payment Administration Agent(s): 
   1. You consent to both Heuston Gaming and our third party payment processing agent and payments facilitators (“Payment Administration Agents”) storing your payment information to process your future purchases in compliance with applicable payment processing regulations.
   2. A Payment Administration Agent will have the same rights, powers and privileges that we have under these Terms and will be entitled to exercise or enforce their rights, powers and privileges as our agent or in their own name. 
   3. In no event will we be liable to any Player for any loss, damage or liability resulting from the Payment Administration Agent’s negligence and/or acts beyond the authority given by Heuston Gaming.

Promotions

1. Applicable Rules: All promotions, contests, special offers and bonuses (“Promotions”) are subject to the Terms, including the Sweeps Rules and to any additional Promotion specific terms published at the time of the Promotion. 
2. Promotion Exclusions: We reserve the right to withdraw or modify or exclude you from any Promotion(s) at our sole discretion without prior notice to you. We may exclude you for multiple reasons, at our sole discretion, including without limitation, promotion abuse (including multiple entries), fraudulent or illegal activity (including access from a Restricted State) or breach of the Terms and withhold, deny or cancel the benefit of any Promotion.
